Fox News Analyst Judge Andrew Napolitano had issued the following question via Facebook,
Well, lets take a look at the U.S. Constitution on the subject of religion. According to an entry by Brittanica.com, this is what was said about the establishment clause under the 1st Amendment,
"clause in the First Amendment to the U.S. Constitution forbidding Congress from establishing a state religion. It prevents the passage of any law that gives preference to or forces belief in any one religion. It is paired with a clause that prohibits limiting the free expression of religion."
The First Amendment itself states,
"Amendment I
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Being that an Ohio Middle School, is funded by tax dollars, the portrait of Jesus would be a violation of the 1st Amendment's establishment clause, thereby violating the U.S. Constitution through its existence. Making the question issued by Judge Andrew Napolitano, moot.
