Power goes out in Downtown Boise again


Mark Reinhardt- Boise Idaho Last night, a White Ball of light has flashed in Downtown Boise, causing the power to go out in certain areas around downtown. Boise police had immediately set up Road Flares for directing traffic in the area.
A local business owner in the area mentioned that this was the second time that the same transformer had blown, causing the power to go out. Describing the scene he said that it looked like the power had gone out for 6 blocks. This has not been the first time that this issue has occurred in the Downtown Area, as Idaho Power has mentioned in Twitter posts, The crowd of people itself had continued on about their way, with the flares set up by Police, having ran out.

In-Depth: Political Ideology and Idaho Law Enforcement Training

On May 2nd, 2013, the Idaho Peace Officer Standards and Training Academy held a seminar on radical religious and political Movements. According to the seminar announcement, this what the seminar covered,

"Emerging Extremism will cover the history and trends of radical religious and political ideologies and their impact on leaders of nation states and their citizenry. Of special note in this presentation will be the rising challenges for law enforcement officials due to the proliferation of extremist beliefs and the waning influence of the nation state. The trend: Disgruntled and unstable people will choose to renounce allegiance to their host nations and opt for primary loyalties that are often based on radical ideologies that may call for violence."

Within Idaho, political ideology was touched on in a training exercise through initiation of a traffic stop on Interstate 84,
 
The video of the drivers interaction was later posted to the Libertarian Party website, making the video itself go Viral. However, not all persons working Law Enforcement in Idaho uses political ideology in the process of performing their duties, as seen with the Boise Police Department helping marchers cross the street during the Million Mask March November 5th,
One of the organizers of the march had made it clear that violence would not be tolerated during the event. In March, the U.S. Department of Homeland Security and the Federal Bureau of Investigation had issued a document on the subject of Political Ideology and the use of Video Recordings,

"For example, in 2010 a Virginia-based US person pled guilty to communicating threats after he posted a video to the Internet encouraging violent extremists to attack the creators of a television show, including highlighting their residence and urging online readers to “pay them a visit.” He also admitted to soliciting others to desensitize law enforcement by placing suspicious looking but innocent packages in public places, which could then be followed up by real explosives."

Speaking on the subject of First Amendment protected activity, the bulletin stated, "First Amendment-protected activities should not be reported in a SAR or ISE-SAR absent articulable facts and circumstances that support the source agency’s suspicion that the behavior observed is not innocent, but rather reasonably indicative of criminal activity associated with terrorism, including evidence of pre-operational planning related to terrorism. Race, ethnicity, national origin, or religious affiliation should not be considered as factors that create suspicion (although these factors may be used as specific suspect descriptions)." http://info.publicintelligence.net/DHS-FBI-ExpressedThreat.pdf

These guidelines, however, have been subject to interpretation by individual officers, leading to an increase of Law Enforcement ordering persons to not film in Public Places. According to the American Civil Liberties Union, this is what they had to say about Filming in Public Places,

"When in public spaces where you are lawfully present you have the right to photograph anything that is in plain view." Further in the guidance document, the ACLU said, "Taking photographs of things that are plainly visible from public spaces is a constitutional right – and that includes federal buildings, transportation facilities, and police and other government officials carrying out their duties. The ACLU later went on to talk about special considerations involved in Video Taping when it came to Wiretap Laws in individual states. Addressing the topic of Civil Liberties in the YouTube Age, a source close to Idaho Law Enforcement said, "The more you do your job, the more it makes my job ten times easier." The subject that was addressed was the issue of Filming Law Enforcement in the performance of their duties. The Officer went on to address the subject, saying, "I don't have a problem with you filming, however, if you get to close, I'm going to arrest you for interfering." An example of what the Officer described was seen in a video involving the Boise Police Department in Downtown Boise at Night, during Apr 1st, 2012
 
Within the video's description box, this is what YouTube user Cyal8rsk8r4 had said of that night, "Taylor is being violently and unnecessarily "detained" at the start of the video. Roughly 10 seconds passed before I pulled out the cam to film what I saw as a overbearing use of force. Basically making sure we obtained video evidence, WE ARE A MEDIA COMPANY."
What was unknown, was the events before the video, where the Officer had yelled at the person behind the camera about getting to close to him previously.

The Idaho Law Enforcement source said, "It really helps us out in the long run." Describing how it protects both sides involved in a Law Enforcement interaction.

Change.org petition surrounding Idaho Faith Healing exemption to Medical Neglect, making rounds on the Internet


Mark Reinhardt- Boise Idaho A change.org petition has been making rounds on the Internet calling upon Idaho Governor C.L. Butch Otter and Idaho U.S. Senators Crapo and Risch to remove legal Immunity for Faith Healing relating to Medical Neglect of children, According to the initial paragraph of the petition, it reads, "Children born into the Followers of Christ church in Idaho are dying at the rate of approximately one per month. Their only medical care is prayer and annointing with olive oil. Their deaths can only be decribed as ritualistic sacrifices. The children die to show the congregation how strong the parents faith is. To seek medical help shows weakness which is not tolerated. No measures are taken to resucitate children when they stop breathing. They just watch until the last breath is taken." Later, Linda Martin, resident of Lowell Oregon described her personal experiences with the church, "I am only one of many children who have suffered abuse and neglect at the hand of this church. Fact Check: Does the City of Boise include online records requests in its website instructions?


Mark Reinhardt- Boise Idaho In a recent conversation through Twitter, Jason Denizac, a resident of Boise, had been having issues with City Records Requests, Later, Denizac wrote, Does, the City of Boise include Electronic Submission for Records Requests in its website instructions? According to the City of Boise's website, this is what was said about how to obtain Public Records, "All Requests can be made directly to the City Department responsible for the record in writing. If you do not know which department is responsible for the record, you can submit the request directly to the Office of the City Clerk. First, click on the Public Request Form electronic submittal link and fill it out. Then hit submit. Driver with Frosted Windows knocks down child, cited for Inattentive Driving


Mark Reinhardt- Boise Idaho Yesterday, the Ada County Sheriffs Department had issued a citation to a driver who had frosted windows, Later, they issued a tweet indicating that the child was not seriously injured, The Driver involved had checked on the condition of the child, according to the Department, Toward the end, the Ada County Sheriffs Department had issued a citation to the driver, Boise Police had issued a video addressing accident prevention involving Frosted Windows and Public Safety, As winter comes into force, Treasure Valley area Law Enforcement has been stepping up efforts to protect pedestrians and travels on the road.

Idaho State Police to host driving simulator to highlight dangers of texting while driving


Mark Reinhardt- Boise Idaho This weekend, the Idaho State Police is putting its simulator on display to highlight the dangers of Texting while Driving. Through the twitter based announcement, a conversation ensued about other kinds of driving dangers, According to the National Transportation Safety Board, "Sending or receiving a text takes a driver's eyes from the road for an average of 4.6 seconds, the equivalent-at 55 mph-of driving the length of an entire football field, blind. Fact Check: Is Idaho Child Protection Services Privately Funded?

What about the means, to which, Child Protective Services is funded in Idaho? Well, according to Tom Shanahan of the Idaho Department of Health and Welfare, this was he said on issues relating to funding of Child Protection Services, "Title IV-E is the principle federal funding source for foster care and adoption assistance. This is the primary funding source to pay foster and adoptive parents a monthly stipend for providing care for foster/adoptive children in their homes. The driving eligibility requirement for IV-E is the child being placed in out-of-home care by the courts or law enforcement. Eligibility also considers income, the case meeting court requirements, and the Department making reasonable efforts to reunify or find another permanent placement for the child. Additionally, the foster placement of the child must meet licensure and safety requirements for Title IV-E payments to be made. Title IV-E funds are not extra money provided to the agency; they are integral to paying for foster care and administrative child welfare functions." What about General Fund dollars in the Idaho State Budget? in-Depth: Protests against Child Protection Services agencies to take place in the continental United States

Grievances involving Child Protection Services include both Cannabis Legalization Activists and those not involved with Cannabis Legalization

Starting today, Cannabis legalization Group Moms for Marijuana will hold a two day protest in in the United States and Germany against Child Protection Services agencies in those respective countries. Highlighting specific cases, the group hopes to change the practices of the agencies towards parents who use Medical Cannabis. The issue itself, is a rather personal one, as Serra Frank, founder of Moms for Marijuana is personally involved with a Child Protection case through her Boyfriend Billy Fisher, involving his daughter Lilly Fisher. Who is currently in custody of Spokane Washington Child Protection Services as of this report. Other cases cited by the group, are Daisy Bram, of freemybabies.org, and the Idaho Three Case involving Sarah Caldwell, Josh Rinehart, and Lindsey Rinehart.

There is however, more to Child Protection Services than issues relating to the War on Drugs. In 2007, Late Georgia State Senator Nancy Schaefer had issued a report titled, “The Corrupt Business of Child Protection Services.” Focusing on the State of Georgia, Senator Schaefer described an ordeal that was faced by one of her constituents in her district. In her report, she had described her introduction to Child Protection Cases, “My introduction into child protective service cases was due to a grandmother in an adjoining state who called me with her tragic story.” Further describing how Child Protection Services misinterpreted the legal standard for such cases, Senator Schaefer said in her report from that year, “In one county a private drug testing business was operating within the DFCS department that required many, many drug tests from parents and individuals for profit."

In another county children were not removed when they were enduring the worst possible abuse.” Her report had concluded that there was no accountability in the system, also describing her belief that the system itself was broken beyond repair nationwide. Senator Schafer speaking of the need for Child Protection Services stated, “This is not to say that there are not those children who do need to be removed from wretched situations and need protection.” The report she issued, focused on the subject of “Legal Kidnapping.”

State Senator Schaefer later died in 2008 after the issuance of that report. The Foster Care Program within Child Protection Service agencies is financed through Title IV-E of the Social Security Act, which requires states to create a state plan for how that money is used by the agency within that state.

For example, in the act it states, “(1) Eligibility.—Each State with a plan approved under this part shall make foster care maintenance payments on behalf of each child who has been removed from the home of a relative specified in section 406(a) (as in effect on July 16, 1996).“ Money is given each month for the amount of time a child spends in Foster Care. Payments cover costs associated with involvement in a child's life.

Amounts paid to Foster Parents differ from State to State, covering various cost of living levels depending on Municipality. In Idaho, Foster Care Payments were increased on July 1st, 2013 through approval by the Idaho State Legislature, according to a letter issued by the Idaho Division of Family and Community Services. The letter itself, had listed the dollar amounts, in this fashion, Ages 0-5 $329 per month per child from $301 Ages 6-12 $366 per month per child from $339 Ages 13 + $487 per month per child from $453 Addressing the issue of Foster Care Payments and eligibility requirements, Tom Shannan, Public Information Officer for the Idaho Department of Health and Welfare said,
 

In April of this year, the Idaho Department of Health and Welfare had faced an audit in relation to costs associated with Foster Care, and compliance with Code Federal Regulation regarding safety and licensor. Comprised of a Multi-Agency approach, the findings of the report found, “77 of the 80 cases met eligibility requirements (i.e., were deemed non-error cases) for the PUR. There were three (3) cases determined as in error for either part or all of the PUR, and six (6) non-error cases where title IV-E was claimed for unallowable costs.” The April audit went further to highlight the dollar amounts associated with Improper Payments, Error example #29:

Federal Participation total was listed as, “$19,968.80” according to the audit. According to a FY 2011-2012 Financial Report, these were the dollar expenditures Family and Community Services had listed for 2012.
Addressing the subject of bonsus given for adoption, Shanahan stated,

This is done through the Fostering Connection Act of 2008, which allowed for states to receive bigger bonuses for higher adoption percentages than the 2002 percentage, “Fostering Connections enhances incentives available under previous law to promote the adoption of children from foster care. It renews the Adoption Incentive Grant Program for an additional five years; resets the adoption baseline on which adoption incentives are based to the number of adoptions in FY 2007; doubles the incentive payments for adoptions of children with special needs and older children adoptions; and gives states 24 months, rather than the previous 12 months, to use their adoption incentive payments. Fostering Connections also permits states to receive an additional payment if the state’s adoption rate exceeds its highest recorded foster child adoption rate since 2002.” Rates of adopted children and children in Foster Care through Title IV-E is described as a “Penetration Rate.” As former director Michelle Britton described in a December 2009 Memo to FACS staff,
  She went on to further describe how to improve outcomes in relation to those rates,
 Social Workers familiar with Child Protection Service functions argued that this can be considered a good thing, when considering that some children live in violent homes, or unsafe conditions relating to sanitation.
An example of a child not removed from such environments was Robert Manwill, whose case had prompted an Independent Review of Child Protection Services practices within Idaho. According to the report, Robert had been living with his mother Melissa Jenkins, and her boyfriend Daniel in the events leading up to the case issued against them. Warning signs involving the safety of Robert were ignored by the agency in the events leading up to his death. The report itself further described the efforts to disguise the situation at the home, revealed during the Criminal Trial, “ Despite this level of frequency, testimony at Daniel Ehrlick’s criminal trial indicated that the home situation was staged for the visits to disguise developing issues.” he frequency of home visits that were mentioned in the report was three times a week.
Questions relating to Imminent Danger and safety of children was the subject of a widely publicized case known as, “The Idaho Three.” Boise Police had removed the children of Sarah Caldwell, Josh Rinehart, and Lindsey Rinehart after discovering the presence of Cannabis in the home. During the April 29th Idaho Three Press Conference, Lindsey Rinehart said of that situation, “It has been alleged that my children have been removed from my house due to being in imminent danger, due to Cannabis being present in our household.” As she further described the situation, she explained why she was challenging the imminent danger portion, of why her children were removed, “We’re challenging the Imminent Danger, due to, the fact that Cannabis is a Non-Toxic Substance. Therefore, how could a child be in Imminent Danger due to its presence?”

However, Russ Belville, host of the Russ Belville Show and staff writer for High Times Magazine had written on this topic for High Times, called, “5 Pro-Pot Myths That Must Be Busted.” Addressing the claim that Marijuana is harmless, he said, “5. Marijuana is harmless Nothing ingested is harmless; you can die from drinking too much water or eating ten raw potatoes. Some experience a cyclical vomiting syndrome from long-term cannabis use. Pot not advised for people with some mental illnesses, and if you’re smoking it, while it’s not tobacco, you're still smoking, which is not healthy.”

Rinehart was using Cannabis to treat symptoms related to her Multiple Sclerosis, describing how it worked for her at the Idaho Three Press Conference, she said, “You can see the difference, I had a sagging eyebrow, I had a sagging lip, I started using Cannabis to treat my condition and my eye brow doesn’t sag anymore, My lip doesn’t sag anymore. I have not been able to consume Cannabis since they took my children, and I’m already getting sick again.”

Addressing the nature of her children being near Cannabis, she said, “Our children knew it was medicine, they knew to stay out of it, just like any other drug. Any other cough medicine, if there was. They knew not use Tobacco, they knew not to use Alcohol, they knew not to use any medication at all.” Through a fund raiser campaign, the Rineharts were able to move to Medford Oregon, where Medical Cannabis is legal within that State. Asking about substance abuse in Child Protection cases, IDHW spokesman Shanahan stated,

California however, has stood in contrast to Idaho in terms of Child Protection issues. This year a child was taken from his parents for seeking a second medical opinion, prompting a member of the California State Assembly to call for a Financial Audit of Child Protection Services within that state,
The case itself had taken place in Sacramento which was further expanded by California Assemblyman Tim Donnelly, in an appearance on Fox News, Medical Cannabis is legal under California State Law. The parents highlighted in the Sacramento story were not involved in Cannabis legalization efforts. Documents posted on the California Department of Social Services website had listed the following as the state wide base rate for Foster Families in August 2013, Los Angeles County Child Protection Services had spent $93,443,648 in Foster Care assistance dollars for the partial fiscal year 2011-2012, according to documents obtained through the California Public Records Act. As parents take to the streets in protest over targeting by Child Protection Services today. the General Accounting Office of the United States Congress had already started to address Foster Care Finance reform in March of this year. According to that report, five proposals were on the table to change the structure of Foster Care Finance. Explaining the summary of results, the report stated, “Twelve of the 14 proposals we identified would eliminate means testing altogether as a requirement for states to receive federal funding to help pay for the costs associated with supporting children in foster care. Two other proposals would link means testing to a different benchmark. Half of the proposals would mitigate a potential increase in federal costs due to the elimination of means testing by either changing the rate of federal reimbursements, capping federal funding, or both. Additionally, half would attempt to mitigate the potentially negative effects of lowering the reimbursement rate on states by, for example, allowing states to access additional funding in the event of an unanticipated increase in foster care placements.” The protests within the continental United States will occur in the States of Washington, Texas, Oregon, California, and Colorado. Addressing detractors, Moms for Marijuana had stated that Child Protection Services grievances affects more people than those involved in Cannabis Legalization activism. Planning Fees cited as a source of Financial Hardship for doing business in Meridian Idaho


Mark Reinhardt- Boise Idaho During the months of April and May, the Commercial Real Estate arm of Arkansas Corporation Wal-Mart was working on modifying the original development agreement issued to them by Meridian Idaho Planning and Zoning. According to The 2012-2013 Annual report for the city, Property Taxes, Water/Sewer, and rebudgeting were listed as the highest sources of revenue, The primary allocation for the Meridian City Budget, is for City Support services and the Police Department, water and sewer being the third focus. As local businesses in the area struggle financially, budget allocations have placed Public Assistance and Public Safety as top city priorities.

ACLU Idaho announces Federal Lawsuit against the City of Boise Idaho over Aggressive Solicitation Ordinance 34-13


Mark Reinhardt- Boise Idaho On Monday, the Idaho ACLU announced at a Press Conference that they would be suing the City of Boise Idaho over a recently passed Aggressive Soliciation Ordinance. The Ordinance, which passed the Boise City Council on September 17th 2013. Is being challenged by the Idaho ACLU on the grounds of 1st Amendment violations, stating, "The ACLU relies on private donations of money and other things of value to carry out that mission. Its staff, board members, and volunteers often and frequently solicit donations from individuals, seeking immediate donations of money and other things of value." Addressing the issue of how the Ordinance affects the Idaho ACLU, the complaint further stated, "To comply with the City of Boise’s new anti- solicitation ordinance would require the ACLU to significantly alter its solicitation activities and to plan both the substance and location of its speech." Larry Shanks, and Troy Minton, were the other two plaintiffs in the lawsuit against the City of Boise. According to Mr. Minton, this is how he would be affected by the Ordinance, Idaho ACLU Legal Director Richard Eppnik stated at the Press Conference that he did not believe that Boise Police would enforce the Ordinance even handedly. SCI Construction worker harasses me over filming in a Public Place (11-3-13)


Mark Reinhardt -Boise Idaho Around the early hours of the morning, a construction worker affiliated with SCI had harassed me for filming in a Public Place at the intersection of Bannock and 8th. Originally, I was filming due to asking a local resident of an apartment building near the area what was going on with the construction on 8th Street. To which the person had indicated that there was communications equipment construction going on. It was from there, I had decided to film the situation involving the construction that was occurring near the intersection. After a certain amount of time, I was approached by an employee of a construction company called SCI, who demanded that I stop filming and leave the area, Looking at the barricades behind me, there was To my right side, where I happened to be standing during the confrontation with the SCI Construction worker. View Larger Map I had called Boise Police to the intersection of Bannock and 6th, so, I felt comfortable in talking to them about the situation. Officers who responded to my call had helped me understand the other persons point of view, and that I should use my Zoom Lens in the future to avoid confrontation.

Blackfoot Idaho Urban Renewal Efforts will focus on businesses close to the Intersection of Judical and Birch Street

During an August 8th City Council Meeting in Blackfoot Idaho, the City's Urban Renewal agency had requested expansion of the Urban Renewal District to the Intersection of Judicial and Birch Street. Citing concerns over decaying structures and unsanitary conditions. According to Google Maps, the businesses included within the immediate intersection, were a Washington Federal Bank Branch, a Farmers Insurance Office, and a Car Dealership.

The images themselves were taken in 2011, two years before the August 8th meeting. The Urban Renewal Agency had also expressed their concerns about damages to life and property. A recommendation was given to Blackfoot City Council not to expand the district beyond the proposed measure. New Twitter Hashtag gives social media users a glimpse into the job of global Law Enforcement


Mark Reinhardt - Boise Idaho Yesterday, Law Enforcement Agencies around the world were providing a glimpse into the workings of Law Enforcement through the Twitter Hashtag #poltwt. In Idaho, the Hashtag was termed a, #TweetAlong by some Twitter users, One of the major highlights from the series of tweets was the pursuit of a suspect in Garden City Idaho. Boise and Idaho State Police were both responding to that call, Idaho State Police were unable to get the person into custody, but found a lead in the process Both the Idaho State Police and Boise Police ended their "Tweet alongs" at around 1:00 AM.

Mountain Home Resident complains about Commercial Business Noise. City Council informs him that the Railroad does not fall under the jurisdiction of City Ordinance


Mark Reinhardt- Boise Idaho During a May 15th, 2013 meeting of the Mountain Home Idaho City Council, Willam James Jr. a resident of the City. Had complained to the City Council about a violation of the city's noise ordinance by a Commercial Business across the street from his residence. According to Google Maps, this is the location of the commercial entity,
View Larger Map James had mentioned the time frame tof the noise, explaining, "the company begins work at 5:00 A.M. and doesn’t finish until dusk each night; as a result all of the people that live on that street are irate." Further explaining that the Mountain Home Police Department had come out with a decibel reader, revealing that the noise was over the ordinance limit. Mountain Home Police Chief Nick Schilz, told the City Council that the noise was a result of a Rail Car operation that was unloading Grain, and that Sam Adams, owner of the company was willing to try and do something. The owner had told the crews involved in the operation that they could not begin work prior to 8:00 AM, having been unaware of the hours that work was taking initially. City Attorney Jay Friendly, had mentioned that the Federal Government had taken jurisdiction over the issue, on the basis of Railroad Cars and Interstate Commerce. Suggesting that the Police call the Environmental Protection Agency to see if the noise violated their regulations. A brief exchange over the issue of rights took place between the Mountain Home Mayor, and James over the subject of rights. Ultimately leaving the issued to the EPA. Addressing the issue of Jurisdiction, Mayor Rist mentioned that the Noise Ordinance of Mountain Home doesn't apply, and that the Railroad doesn't have to follow the same rules as everyone else. Fact Check: What are the facts surrounding the zoning issue discussed at the January 14th, 2013 Mountain Home City Council meeting?


Mark Reinhardt- Boise Idaho On January 14th, 2013, Mountain Home Idaho Resident So Young Mays met with the City Planning and Zoning Commission to build a bigger fence on her property, according to City Council Meeting Minutes. According to the mintues, the reason for her going to the commission was, “To build her fence up to eight feet tall because the new house that was built behind her is very close to her fence and she can see into their front window while sitting on her couch.” According to Google Maps, the view from her backyard actually faces the back end of the house,

View Larger Map During the council meeting, Mountain Home Mayor Tom Rist had asked Mays if she previously had neighbors when she moved in. To which, she had responded to the mayors question with a no. Rist indicated, "in 90% of the houses in any subdivision, you can see into anyone’s house if you look out of your window from inside your house." An example of this can been seen in Boise Idaho through the Creekwood Subdivision where the placement of the fences allowed for neighbors to be able to do this.

Was one side more correct than the other? I don't know. What is known, is that the Internet now allows a person to examine Municipal Planning and Zoning issued with the click of a button.

Boise Police make drug bust during traffic stop last weekend


According to the Boise Police Department, a fugitive from South Dakota was busted for Marijuana possession. The Press Release itself stated, " Boise Police observed a vehicle driving West on Overland Road near South Phillippi Street without license plates or a temporary registration early Sunday morning, October 27th, at approximately 5:06 a.m. Officers stopped the driver near South Phillippi Street and Bel Air Street. Officers recognized the distinct odor of an alcoholic beverage when they approached the vehicle. A check through Boise City Records indicated the suspect had an outstanding felony warrant for his arrest out of South Dakota, resulting in the Fugitive to Idaho charge." Paramedics called to the scene in Downtown Boise Friday/Saturday Night


Mark Reinhardt- Boise Idaho Last night, the Ada County Paramedics were called to the scene in Downtown Boise, Across from the scene, a woman shouted, "Oh my god, I'm so drunk I need an ambulance!" The man lying on the ground was later taken to the hospital, When asked if the man was drunk, officers at the scene were unsure, but stated that he might have had a concussion. No further information is available at this time.

Fact Check: Should an Ohio middle school be forced to remove a portrait of Jesus?


Mark Reinhardt- Boise Idaho Fox News Analyst Judge Andrew Napolitano had issued the following question via Facebook,
Well, lets take a look at the U.S. Constitution on the subject of religion. According to an entry by Brittanica.com, this is what was said about the establishment clause under the 1st Amendment, "clause in the First Amendment to the U.S. Constitution forbidding Congress from establishing a state religion. It prevents the passage of any law that gives preference to or forces belief in any one religion. It is paired with a clause that prohibits limiting the free expression of religion." The First Amendment itself states, "Amendment I Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." Being that an Ohio Middle School, is funded by tax dollars, the portrait of Jesus would be a violation of the 1st Amendment's establishment clause, thereby violating the U.S. Constitution through its existence. Making the question issued by Judge Andrew Napolitano, moot.

Boise Police Department looking for suspects involved in Les Bois Jr. High School shooting, no updates so far


Mark Reinhardt- Boise Idaho The Boise Police Department is currently looking for people involved in a shooting at Les Bois Junior High School in Boise Idaho.
View Larger Map Credit: Google Map Image of Les Bois Junior High school According to the Press Release issued by the Department, it stated, "What Happened: Overnight Investigating officers say there's evidence that someone stood at the edge of the parking lot at Les Bois Junior High and fired four shots toward the school at 12:05 this morning. The shots entered a door. No one was hurt. Officers believe the shots were fired from a .22 caliber handgun. Security footage (below) from the parking lot shows two vehicles whose occupants seem to know each other, driving through the lot between 11:43 p.m. last night until the time the shots were fired, 12:05 a.m. One vehicle is an SUV, the other is a light colored car. Area residents had expressed cooncerns about the events on Twitter, In response, the Boise Police Department said, Officers are looking for suspects described as between the ages of 15-18. No further information is available at this time, more updates will be filed, as soon as, information becomes available.

Idaho State Police looks to raise fees for Public Safety and Security System


Mark Reinhardt- Boise Idaho The Idaho State Police is set to raise fees relating to the ILETS network, a computer system that services as an information conduit in terms of Public Safety and Security. According to a memo issued by Idaho State Legislative Services, this was the rational for the fee increase,

ILETS stands for the Idaho Law Enforcement Teletypewritter System, slightly based off of National Law Enforcement Teletypewritter System, available at the National Crime Information Center. The memo had also discussed another proposed rule change covering the Criminal History information systems. In addressing the cost it would take to keep the ILETS network running, it had given a table outling the amended fee structure. In addressing the impact to the Idaho State General fund, the proposed rule stated, "This rule does not create an impact on the general fund. However, additional funding of the ILETS System is being sought to augment financial need for operation of the System."

Idaho State Police to change practices relating to Criminal History information exchange


Mark Reinhardt- Boise Idaho The Idaho Department of Administration has issued a bulletin announcing a rule change on the subject of Criminal Justice information services. According to the proposed rule, it states, "This rule will include terms defined in Section 67-3001, Idaho Code. This rule will also provide a procedure for the expungement of a person’s criminal history record, for the transmittal of criminal history arrest fingerprints, and for a person to contest to the accuracy and completeness of a criminal history record in the database of the Bureau of Criminal Identification, as allowed pursuant to Section 67-3001, Idaho Code." The proposed rule issued by the Idaho State Police, stated that there would be no fees associated with this rule, however, in terms of Tax Dollar impact, it states, "FISCAL IMPACT: The following is a specific description, if applicable, of any negative fiscal impact on the state general fund greater than ten thousand dollars ($10,000) during the fiscal year resulting from this rulemaking: There is no impact on the general fund." Included in Criminal Histories, are DNA samples in relation to offenders, as this video from the Idaho State Police Forensic Science Services talks about, Written comments in relation to the proposed rule are due by October 23rd.

Press Conference for Spokane Washington Child Protection Case to be issued October 9th


Mark Reinhardt- Boise Idaho A Press Conference has been announced for a Child Protection Case involving Moms for Marijuana founder Serra Frank, and Billy Fisher. The Press Conference October 9th, is to take place in Spokane Washington
According to the Fight for Lilly Facebook page, this was the inital actions surrounding the case, "He explained that he cannot just go over and demand Billy's child from him, because we didn't have a court order, but he could try to contact the man who had her and see if he would willingly relinquish Billy's daughter." Moms for Marijuana had issued the following video about the case September 19th, According to Washington State Law on the subject of Medical Cannabis, and the issue of parenting, it says, "69.51A.120 Parental rights or residential time — Not to be restricted. A qualifying patient or designated provider may not have his or her parental rights or residential time with a child restricted solely due to his or her medical use of cannabis in compliance with the terms of this chapter absent written findings supported by evidence that such use has resulted in a long-term impairment that interferes with the performance of parenting functions as defined under RCW 26.09.004." RCW 26.09.004, went into further detail on the subject of parental functions, touching on the issue of Military Deployment in relation to Military families and Child Care. A Nationwide protest against Child Protection Services Agencies is scheduled for November 12th, this year.
